Gaming Compliance in 2026: A Briefing for Malta and Cyprus Operators

Country-specific gaming compliance review points and a supplier-research example, without assumed DORA flow-down or automated licensing checks.

Gaming compliance is activity- and country-specific. The European Commission states that there is no sector-specific EU gambling-services legislation and no general obligation to recognise another country’s gambling licence. Malta and Cyprus must be assessed separately.

Keep the legal perimeters separate

Identify the licence, activity, legal entity and target markets. Check current MGA or Cyprus authority rules directly rather than infer that betting and casino requirements are interchangeable. Assess AML, customer due diligence, data protection, advertising and player-protection duties under the applicable national framework.

DORA does not automatically apply to a gaming operator. Test the entity against Article 2. A relationship with a payment provider does not create a universal DORA flow-down obligation; assess the actual service and contract.

Review AI uses by intended purpose against the current AI Act. Do not classify fraud or responsible-gaming tools as high-risk solely because they use AI. Review personal-data processing and profiling under GDPR as a separate legal exercise. This article does not assert recent enforcement findings, licence-renewal practices or regulator-approved templates.

Illustrative product example: supplier due diligence

A gaming procurement team could evaluate Lexis Diligence on a public supplier, examining company and negative-news information and the reasons for a reviewer’s decision. Confirm datasets, geography and monitoring options. This does not demonstrate player identity verification, source-of-funds sufficiency, transaction monitoring or a gaming licence compliance score.
