MiCA Compliance: A 2026 Guide for Crypto-Asset Service Providers

MiCA service scope, authorisation and client-protection review points, with official sources and an illustrative counterparty research workflow.

MiCA establishes requirements for covered crypto-assets, issuers and crypto-asset service providers. The asset, service and legal entity determine which provisions apply. Do not rely on historic national registrations or assume a transitional permission remains available.

Check the applicable service and evidence

Review Article 59 for the route to providing crypto-asset services, including authorisation and the arrangements for certain already regulated entities. Article 62 addresses authorisation applications; Article 67 and Annex IV address prudential safeguards. For custody, review Article 75 and the actual asset and record arrangements. Title VI addresses market abuse within its scope.

White paper requirements differ for asset-referenced tokens, e-money tokens and other crypto-assets. Notification, approval and exemptions are not interchangeable. Do not assume a white paper is always regulator-approved.

Article 143 set an EU maximum transitional end date of 1 July 2026, subject to earlier national limits and authorisation or refusal. Check the firm’s current status and official authority instructions. DORA and AML obligations require separate scope analysis; a MiCA dossier does not satisfy them automatically.

Illustrative product example: a counterparty research note

Evaluate Lexis Diligence for company information and negative-news research about a public counterparty. Separately evaluate Lexis+ for the relevant legal material in the proposed collection. Record source dates, unresolved ownership questions and professional review. This is not automated dossier scoring, custody validation, transaction surveillance or authorisation support guaranteed by the software.
