MiFID II Suitability for Cyprus CIFs — 2026 Practical Guide

A source-based suitability review for advice and portfolio management, including periodic-review rules and a bounded drafting example.

MiFID II suitability under Article 25(2) concerns investment advice and portfolio management. Appropriateness and execution-only rules involve different conditions. Assess the actual service and client rather than assume one review process applies to every Cyprus investment firm.

Review the recommendation and supporting evidence

Document the required client information, including knowledge and experience, financial situation and investment objectives. Review applicable sustainability-preference requirements under the delegated regulation and current ESMA guidance. Preserve the information used, reasoning and relevant communication.

Where a periodic suitability assessment is provided, Article 54(13) of Delegated Regulation (EU) 2017/565 requires review at least annually, with increased frequency where appropriate. Do not describe annual review simply as a market norm. Check the service-specific duties and current consolidated provisions.

Use current official sources for retention, client reporting and national implementation. This article does not claim suitability is CySEC’s most-cited finding or describe unpublished inspection priorities.

Illustrative product example: a reviewed policy note

Evaluate Lexis+ for the relevant legal sources in its collection and Lexis Create for preparing a document in Microsoft 365. Review a public or anonymised example, not a live client file. Research and drafting do not demonstrate an automated suitability score, validated questionnaire or supervisor-approved evidence pack.
